Privacy and the General Data Protection Regulations (GDPR) 2018

An Bord Pleanála uses your personal data only for the purpose of providing our services and fulfilling our legal duties as set out under relevant legislation.

Data Privacy Notice

Personal data is any information about a living person that can be used to identify that individual.
This data protection notice sets out details of how personal data is processed by or on behalf of An Bord Pleanála (the Board) as a data controller when it is performing its duties in accordance with the Planning and Development Act and other relevant statutes. 
An Bord Pleanála uses your personal data only for the purpose of providing our service and fulfilling our legal duties as set out under relevant legislation. 

The Planning Process

The planning process is an open and transparent process, and in accordance with legislation, members of the public are allowed access to view and obtain copies of all documentation received by An Bord Pleanala in relation to cases decided by it. 

When making an appeal, referral, application or other matter, or an observation or submission to An Bord Pleanála, you should give careful consideration to any personal information, about yourself or others, that you disclose as these documents will become publicly available, either through the An Bord Pleanála’s website, and/or in hard copy through public access at its office. 

Certain Live Cases

In respect of submissions received on live cases relating to proposed road developments under the Roads Act 1993 as amended, (and referral cases and associated submissions once decided), An Bord Pleanála is legally obliged to publish these submissions on its website, and any personal data (name, address, contact details) that is contained in these submissions, will be published in full.

Decided Cases 

In accordance with planning legislation, documentation in relation to cases decided by An Bord Pleanála  must be made available to the public for inspection at our offices and on our website for the following periods:

(a)     where no environmental impact assessment was carried out on the proposed development, for a period of at least 5 years beginning on the third day following the making by An Bord Pleanála of the decision, 
(b)     where an environmental impact assessment was carried out on the proposed development, in perpetuity beginning on the third day following the making by An Bord Pleanála of the decision.

Note: in relation to decided cases under (b) above, An Bord Pleanála is legally obliged to publish all documentation in relation to the case on its website, and any personal data (name, address, contact details) that is contained in these submissions, will be published in full.
