Who can appeal?

If you applied to the planning authority for a proposed development, you can make a First Party Appeal.

If you made a submission to the planning authority on a proposed development, you can make a Third Party Appeal.

(Note: For third party appeals, you must include the planning authority's acknowledgement letter with your submission)

How much time do I have to appeal?

You have four weeks starting on the date the planning authority makes its decision. The decision date is when the chief executive's order is signed. This is a strict time limit.
If the last day falls on a weekend or Public Holiday when the Commission's offices are closed, your appeal is valid if received on the next working day.

Appeals Checklist

Make your appeal to An Coimisiún Pleanála in writing and either:

Submit via our Online Appeal Platform
Send by post
Deliver it to us in person to a Commission employee during office hours.
You can use this form to assist – but no official form is required.

You must clearly state your own name and address. If someone is acting for you, like a planning agent they must clearly state their own name and address as well as your name and address.

You must give us enough details to allow us to identify the application you wish to appeal. Examples of the details we accept are:
A copy of the planning authority decision, or
The name of the planning authority and the planning register reference number (for example: Ballytown City Council, 23719/18)

You must provide your planning grounds of appeal (reasons and arguments) for your appeal and any items you wish to support your grounds of appeal.

An Coimisiún Pleanála will receive a complete copy of documents, drawings and maps that were submitted to the local planning authority as part of the planning application stage and are displayed on the planning authority's website. Therefore, we advise you to not to upload any of these documents as part of the supporting material with your appeal. When uploading supporting material, please only include new documents. (This does not apply to third party appeals where you must include a copy of the planning authority's acknowledgement letter)

You must pay the correct fee.

You must make your appeal within 4 weeks from the date that the planning authority has made its decision.

You may be able to appeal if:

You have an interest in the adjoining land: Apply for leave to appeal
You are a prescribed body not legally notified of the application by the planning authority, or
You are an environmental protection group (only applies if a required EIAR was missing).
