Statement on ABP-314485-22 relating to the night-time use of the runway system at Dublin Airport

Regulation 598/2014 (the ‘Regulation’) is an instrument of European Union law that regulates noise-related operating restrictions at EU airports.
The Regulation is transposed into Irish law by the Aircraft Noise (Dublin Airport) Regulation Act 2019 (the 2019 Act), which also made amendments to the Planning and Development Act 2000. An Coimisiún Pleanála is the competent authority to hear appeals under the legislation.
On 16 July 2025, An Coimisiún Pleanála issued its decision in ABP-314485-22 relating to the night-time use of the runway system at Dublin Airport.
As provided for by the Regulation and the 2019 Act, An Coimisiún Pleanála notified the European Commission and Member States of its decision. As also provided for by the Regulation and the 2019 Act, the European Commission may review a proposed operating restriction.
In accordance with Article 8(3) of the Regulation, the European Commission has now provided notice that the proposed operating restriction does not comply with Article 5(3) of the Regulation: Commission Decision C (2026) 919 final
In accordance with the Regulation and Section 27 of the 2019 Act, An Coimisiún Pleanála will now examine the EU Commission notification.
It will consider whether to reopen the process and if so, at which point to reopen the process. An Coimisiún Pleanála will notify the public and the parties to the decision on the conclusion of this consideration.
