Statement: Position on Mediation in Judicial Review Cases of ACP decisions

Several press articles published on 4^th and 5^th November 2025 contained the incorrect statement that An Coimisiún Pleanála will enter mediation with Alcove Ireland Three Ltd in relation to a challenge to ABP-320164-24 Dart+ Coastal North Railway Order Decision.

To clarify, An Coimisiún Pleanála has not been asked to enter mediation and nor has it given any such undertaking.

An Coimisiún Pleanála does not participate in mediation in a challenge to one of its decisions. This reflects the Commission’s public law role where we make decisions according to statute, planning and the common good. Mediation involves confidentiality (as set out in section 10 of the Mediation Act 1997) and such confidentiality would be at variance with our transparency obligations as a statutory decision-maker and the interests of third parties.
