  The Board issued a split decision in this case.  The refusal part of the Board’s decision in ABP-311844-21 was subject to Judicial Review.  By order of the High Court (Perfected on the 9th November, 2023), that refusal part was quashed and remitted back to the Board for fresh determination.  The new number assigned to this part of the decision is 319304 and should be viewed in conjunction with the grant part in ABP-311844-21,  which was not subject to Judicial Review and remains valid.
